Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Sky Wholesale Table application ("the App"), developed and operated by Sky Apps ("we", "our", or "us"). By installing or using the App, you agree to these Terms. If you do not agree, please uninstall the App.

1. Eligibility

The App is designed for use by Shopify merchants. By using the App, you represent that you have the legal authority to enter into these Terms on behalf of yourself or your business, and that your use of the App complies with all applicable laws and Shopify's own terms and policies.

2. Description of Service

Sky Wholesale Table provides wholesale tier-based pricing tables for Shopify product pages. The App allows merchants to create bulk discount offers with customizable pricing tiers that are displayed to storefront visitors via a Shopify theme app extension.

Features vary by plan. Free plan features and paid plan features are described on the App's pricing page within the Shopify admin.

3. Billing and Payment

Paid plans are billed through Shopify's Billing API. All charges appear on your Shopify invoice. By selecting a paid plan, you authorize Shopify to charge the applicable fees to your account.

You may upgrade or downgrade your plan at any time from within the App. Downgrades take effect at the end of the current billing cycle. We do not issue refunds for partial billing periods except where required by applicable law.

Free trial periods, where offered, begin on the date of plan activation. After the trial ends, you will be charged at the applicable rate unless you downgrade to the Free plan before the trial expires.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of Shopify's Partner Program Agreement or API Terms of Service.
  • Attempt to reverse-engineer, decompile, or extract the source code of the App.
  • Use the App to transmit spam, malware, or any harmful or deceptive content.
  • Interfere with or disrupt the integrity or performance of the App or its underlying infrastructure.

5. Intellectual Property

All rights, title, and interest in and to the App — including its code, design, branding, and documentation — remain the exclusive property of Sky Apps. These Terms do not grant you any ownership rights in the App.

You retain ownership of all data, content, and configurations you create within the App (such as pricing tiers and offers), which are stored as Shopify metaobjects within your own Shopify store.

6. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process merchant data only as necessary to provide the App's functionality, as described in the Privacy Policy.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or compatible with all Shopify themes.

8. Limitation of Liability

To the fullest extent permitted by law, Sky Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including loss of profits, data, or business opportunities. Our total liability for any claim relating to the App shall not exceed the amount you paid us in the three months preceding the claim.

9. Modifications to the App

We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We will make reasonable efforts to notify you of material changes that affect your use of the App.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Effective date" at the top of this page. Continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Sky Apps operates, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
